ARTICLE 2 – Definitions
Website : the Homira website and all of its pages.
Seller : ARCKER COMMERCE, operating the Website under the Homira brand.
Product : any item offered for sale on the Website.
Customer : any natural or legal person placing an order on the Website.
Consumer : any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, professional or agricultural activity.
Order : any order confirmed by the Customer in accordance with the procedure provided on the Website.
ARTICLE 3 – Purpose
These Terms define the rights and obligations of the parties in connection with the sale of the Products offered on the Website, in particular home and pet items. They are accessible at any time on the Website and take precedence over any other document. The Seller may amend them at any time; the applicable Terms are those in force on the day of the order.
ARTICLE 4 – Products
The Products offered are those shown on the Website on the day it is consulted. Each Product has a description setting out its essential characteristics. Images are provided for illustration purposes; slight differences in colour, size or finish may exist. Offers are valid while stocks last. If a Product becomes unavailable after an order is placed, the Customer is informed and may choose between a full refund or waiting for restocking where possible.
ARTICLE 5 – Orders
The Customer selects Products and adds them to their cart. Before confirmation, a summary allows the Customer to check their order and correct any errors. The order is final once the Customer confirms it, accepts these Terms and the payment is approved. A confirmation email is then sent to the Customer.
The Seller reserves the right to refuse or cancel any order in the event of fraud, manifestly incorrect information, non-payment or for any legitimate reason.
ARTICLE 6 – Prices
Prices are shown in euros, all taxes included (TTC), excluding delivery costs, which are shown before the order is confirmed. The price applied is the one displayed at the time of confirmation. In the event of an obvious display error, the Seller may cancel the order after informing the Customer and issue a full refund.
ARTICLE 7 – Payment
Payment is due at the time of ordering, using the payment methods offered (including credit or debit card, Apple Pay, Google Pay or PayPal where available). Payments are secured by Shopify Payments and its partners; banking information never passes through the Seller’s servers and is processed in accordance with the PCI-DSS standard.
ARTICLE 8 – Delivery
Products are delivered to the address provided by the Customer, in the countries offered at the time of ordering. The Customer is responsible for checking that their information is accurate. Delivery times are given for information purposes only. In accordance with Article L216-1 of the French Consumer Code, Products are delivered no later than thirty (30) days after the conclusion of the contract, unless otherwise agreed. In the event of a delay, the Customer may exercise the rights provided for in Articles L216-6 et seq. of the French Consumer Code.
If a parcel is damaged or shown as delivered but not received, the Customer contacts customer service as soon as possible. If a parcel is returned because of an incorrect address, reshipping may be arranged, and the costs may be charged to the Customer.
ARTICLE 9 – Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Consumer has fourteen (14) days from receipt of their order to withdraw, without giving any reason. The Consumer sends their request to contact@homiralife.com, or by using the model form below, and then returns the Products within fourteen (14) days of their decision, complete and in their original condition. The direct costs of return are borne by the Consumer, unless otherwise provided by law.
The refund, including the initial delivery costs up to the cost of the least expensive standard method, is made using the same payment method within fourteen (14) days; the Seller may defer it until the Products have been recovered or proof of their shipment has been provided.
The right of withdrawal does not apply, in particular, to personalized Products, to unsealed Products that cannot be returned for reasons of hygiene or health protection, or in the other cases provided for in Article L221-28 of the French Consumer Code.
